In these terms and conditions the following meanings will apply:
The Company means Creative Auto, whose registered office address is at Unit 4, Armley Link Trading Estate, Armley Road, Leeds, LS12 2QN. Tel: 0113 279 9979
Customer means the person or company whose details are entered on any order or enquiry form.
Public means any person viewing or gaining access to designed drawings.
Products offered by Creative Auto include car styling and improvements, installations and diagnostics. The company undertakes that all products are of suitable quality for purpose (however Customers are asked to ensure that size, style and colour details are carefully checked and agreed before ordering, as mistakes may not be rectifiable). Limitations in screen resolutions and effects of lighting may mean that the colour of your chosen product may differ slightly from that shown on the screen.
No contract will exist between Creative Auto and the Customer for the sale of any product, until The Company accepts receipt of an agreed deposit confirming the order. The contract when formed will be deemed to have been concluded in the UK and will be interpreted, construed and enforced in all respects in accordance with the laws of the UK, and will be subject to the jurisdiction of the UK Courts.
The Company may refuse to accept an order where goods are not available; where we cannot obtain authorisation for your payment or if there has been a pricing or product description error.
To facilitate effective processing of orders, Creative Auto offers secure payment facilities. We accept payment by major credit cards or debit cards by this method via Paypal
Personal details are encrypted during transmission and stored and used strictly in accordance with the Companies Data Protection Policy and will not be passed to any third party without your explicit permission.
Alternatively payment may be made in person at the Company’s premises or by cheque or bank transfer by arrangement at time of contract
Delivery of products ordered will normally be made within 5-7 working days within the UK..
Creative Auto will endeavour to ensure accurate delivery of all orders, but Customers should be aware that actual delivery to the Customer will be determined by both the Company's suppliers and Couriers’ delivery times. It should be understood that this is outside the direct control of the Company.
The Customer will become the owner of the goods they have ordered when they have been delivered to the Customer. Once goods have been delivered to the Customer they will be held at the Customers' own risk and we will not be liable for their loss or destruction. Goods damaged in transit must be noted at the time of delivery, documented on the delivery note and delivery refused.
It is the responsibility of the Customer to check the goods for damage and to notify us of any damages within a reasonable period. We will not accept claims for goods damaged in transit that were originally signed for as being in good condition, unchecked or wording to that effect.
If we are not able to deliver the goods through no fault of our own, we will need to charge for re-delivery at the full rate. We will not accept cancellation of the goods if we experience problems with delivery that is beyond our control.
Creative Auto warrants that all products and services supplied will be of suitable quality and fit for their designed purpose.
Exceptionally however, any discounted or sale products will be sold as is and are specifically excluded from this guarantee.
No guarantee is offered where products are used for purposes other than that for which they were designed.
This warranty is in addition to, and does not affect, your statutory rights under the Sale of Goods Act 1979, Supply of Goods and Services Act 1982, Sale and Supply of Goods Act 1994 and The Sale and Supply of Goods to Consumers Regulations 2002.
Ordering mistakes by Customers with regard to size, colour or specification for example, will not constitute grounds for cancellation. Notwithstanding, acceptance of cancellation by Creative Auto in exceptional circumstances and any refund or part refund will be solely at the discretion of the Company. The product should be unopened. If we receive the product and it is not in the same condition we sent it or it has missing components we willl charge you for the cost of the missing components. We are not able to offer refunds on special orders. Refunds are made as soon as the returned goods have been checked for damage. We will refund through the same payment system that was used for your purchase. Delivery charges will not be refunded under any circumstances where the customer has ordered the goods incorrectly and the goods have been delivered. If an exchange of goods is required we will charge again for delivery at the full rate.
In the unlikely event of products being faulty or of sub-standard quality, please report such problem immediately to Creative Auto. Goods should be returned together with original packaging. In the event of cancellation of the contract, the Customer will be responsible for the safe return, and all costs of return, of the products in an undamaged, unworn state, together with all original packaging. Refunds are made as soon as the returned goods have been checked for damage. We will refund through the same payment system that was used for your purchase. Delivery charges will not be refunded under any circumstances where the customer has ordered the goods incorrectly and the goods have been delivered.
The designs and images are owned and operated by Creative Auto and all contents and designs are copyright of The Company and its suppliers or agents. Public gaining access to designed drawings are permitted limited rights to view and print the contents for personal use only and are prohibited from copying or reproducing or reusing any of the contents or designs in any medium for any other purpose, in particular but not exclusively for any commercial gain.
Title in the goods will pass to the Customer on payment of the full purchase price. Risk however, will be carried by the Company until such time as the products are received by the Customer.
